i) Application to extinguish Bishop's Stortford Footpath 53 through Hockerill College A letter had been received from the Hertfordshire County Council (Definitive Map Officer), confirming that the above matter would be presented to the Development Control Committee at County Hall on 12 September 2006. Members who wished to speak to the Committee were asked to contact the Committee Secretary. Both Cllr Wood and Cllr Pinnell indicated their intention to attend and the Clerk was asked to action this matter.

ii) Maintenance of St Michael's Churchyard To note receipt of a letter from Mrs Jenny Klincke, Secretary of the Parochial Church Council, expressing appreciation to the Town Council for the way in which the Churchyard was being maintained. The Clerk was asked to convey this message to the outdoor staff.

i) The proposal would run contrary to the District Council's Policy which, in urban areas, seeks not to allow new and replacement dwellings which would change the character and amenities of the residential area. This development would be totally out of keeping with the Town in general and Stansted Road in particular

ii) The development represents a gross over development of the site which is deemed to be totally excessive and intrusive in this location and which would change the density of the area

iii) The site is a haven for wildlife with the presence of a number of protected species

iv) The slope of the site to the rear of the houses would cause an unacceptable degree of overlooking with a loss of amenities currently enjoyed by the residents

v) The excessive number of dwellings would generate a disproportionate amount of traffic onto Stansted Road which would seriously compromise road safety at this location, with difficult ingress and egress

vi) The demolition of perfectly good residential accommodation is to be deprecated, especially in view of them being capable of continual residential occupation

vii) The replacement of homes with 17 new dwellings does nothing to enhance the neighbourhood or the character of the entrance to the town.

viii) Inadequate parking facilities proposed within the circumference of the site

ix) The proposal flies in the face of the vision of Bishop's Stortford which contained an essential criteria for adopting Town Plans where seeking to preserve the character of the town and improve its appearance

Applicant: Hampden Homes Ltd To note the following comments from East Herts Council:-

i) This application is for a Deed of Variation to a legal agreement already approved by East Herts Council

ii) There is no statutory requirement to consult neighbours or statutory consultees on such Deeds of Variations

iii) On the letter sent to you on 27 June 2006 it was advised that 'no representations are expected from the Town Council but the application needs to be made available to the public'

iv) The attached report hopefully explains the changes now proposed. However, for clarity, should planning permission be granted for the three new dwellings (LPA ref: 3/06/1155/FP) on the adjacent land at 100 South Street, the Deed of Variation allows for a further affordable unit to be dedicated to the scheme already approved at 96-100 South Street, ie the increase from 13 to 14.

v) Members at the Development Control Committee, on 26 July 2006, resolved to vary the S106 and this is currently being progressed with East Herts Council's solicitors. 212. PROPOSED PERMANENT TRAFFIC ORDERS: JACKSON SQUARE A letter had been received from the Hertfordshire Highways enclosing a detailed plan setting out the proposed Traffic Orders for the Jackson Square development (see attached). The primary changes proposed, following the close of the consultation period, were as follows:-

i) Removal of the 'No Right Turn' ban from Masterman Wharf into the Causeway

ii) Adderley Road and the Causeway will both be subject to 'No Waiting or Loading at Any Time'.

iii) Adderley Road will be subject to a 'One Way Order' with a 'No Right Turn' ban from the Causeway into both Masterman Wharf and Adderley Road. Members confirmed their agreement to the above Orders with a request that there be an extension to the Taxi Rank in Riverside

213. THE HERTFORDSHIRE (HAYMEADS LANE) (RESTRICTION OF WAITING) ORDER 2006 Notice had been received that the Hertfordshire County Council was proposing to make an Order under the Road Traffic Regulation Act 1986, to introduce no waiting 0900 to 1000 Monday to Friday in Haymeads Lane as set out below:- 'Both sides of the road from a point 23 metres west of a point in line with the boundary between 59 and 61 Haymeads Lane eastwards for approximately 125 metres to a point
15 metres east of a point in line with the boundary between 75 and 77 Haymeads Lane.' RESOLVED: that the above be noted

214. ROAD HUMPS NOTICE (BELDHAMS LANE) 2006 A letter had been received from Hertfordshire Highways confirming that the Hertfordshire County Council was intending to construct a set of speed cushions in Beldams Lane, to be located at a point approximately 42 metres east of its junction with the east kerbline of The Wraglins. RESOLVED: that the above be noted

215. COMMUNITY EMPOWERMENT AWARD Members had been circulated with copy correspondence from both the East Herts Council and the National Association of Local Councils with regard to the success of the Town Council in achieving a Regional Award, sponsored by the Commission for Rural Communities.

The award was in recognition of the achievements of the partnership between the District Council and the Town Council in recognising and seeking to address the problems of migrant workers to the area. A formal presentation of the Award was to be made at the NALC conference, to be held in Liverpool on the weekend of 22-24 September 2006. Miss Monika Wodecka, currently employed by the Town Council, was now actively involved on a weekly basis in the role of liaison officer with the Polish community.

The funding for such activity was being met by the East Herts Council. With regard to the cash award, which amounted to £750, it was proposed that this sum be utilised to re-evaluate the remuneration currently paid to Monika. Members expressed their pleasure on the achievement of the Award and they were appreciative of the Clerk's input in this regard. Additionally they wished to place on record their gratitude to Monika for her services rendered.

218. OFFICE ACCOMMODATION The Clerk tabled a report for members' consideration, setting out a proposal for utilising office accommodation within the Old Monastery. RESOLVED: that an agreement be entered into with Mr Higgins for a period of two years, determined by either side at the end of one year, for an agreed rental of £3,500

202. PLANNING NOTIFICATIONS:

i) The Town Council had convened this special meeting of the Vacation Committee in order to fully consider the following planning notification and to evaluate the views of local residents at Community Voice meetings, Residents Associations and the Civic Federation: Members requested that the following comments be proffered:

3/02/0962/OP 19/4/04 (Jackson Square Phase 2) Land adj to Riverside Applicant: David Ward

i Members expressed their concern at the proposed height, bulk, density and overall impact of the proposal. Members were of the opinion that the proposed flats should be of no more than three storeys in height in order to limit the chasm effect on the river. Members were of the opinion that any further enclosure of the river would detract from its appearance and usage.

ii The plans for the new square were inadequate in that no detail was indicated in the plans. Furthermore, members considered that the current artist's impression of the square on the advertising hoardings was extremely misleading and should be removed.

iii Members wished to ensure that the landscaping was sympathetic to the river and that a full landscaping scheme was in place prior to the commencement of building work. The retention of the trees was considered to be important.

iv Members wished to see the taxi rank expanded.

v The buildings were considered to be of poor design, and members requested that high quality building materials be used in order to prevent the buildings becoming shabby.

vi. It was noted that there was nothing in the proposal which indicated compliance with the new regulations being introduced next year regarding environmentally friendly, sustainable initiatives. e.g. solar panels etc. It was requested that East Herts Council carefully consider the implications of the development and give recognition of the comments proffered by the Town Council prior to determination of the application.

Members had been circulated with revised and re-numbered planning policies for the Town Council to which members made some minor grammatical alterations.

RESOLVED: that the revised policies be adopted and forwarded to East Herts Council for formal ratification.

Social Housing at Nightingales

Cllr Warnell advised members that the land adjacent to the above development was very overgrown and required urgent grass cutting. It was requested that a letter be sent to Tony Long at Circle Anglia.
